TERMS AND CONDITIONS
Last updated: [DATE YOU PUBLISH THIS]
ABOUT THESE TERMS
These terms govern your use of this website, operated by DivineLoveCares Foundation Incorporated ("we", "us", "the Foundation"), a 501(c)(3) tax-exempt organization incorporated in the State of New York, EIN 33-1917805.
By using this website, making a donation, submitting a form, or subscribing to our newsletter, you agree to these terms. If you do not agree with them, please do not use the site.
Our Privacy Policy explains separately how we handle personal information, and forms part of these terms.
WHO MAY USE THIS SITE
You must be at least 18 years old to make a donation, apply to volunteer, or otherwise submit information through this website. If you are under 18, please ask a parent or guardian to act for you.
DONATIONS
All donations are voluntary. When you donate, you confirm that you are the authorized holder of the payment method used, and that the funds are lawfully yours to give.
Donations are processed by Stripe. Your payment is subject to Stripe's own terms in addition to these. We do not receive or store your card number.
A donation is recorded only once the payment processor confirms it to us. If a payment fails, is declined, or is later reversed by your bank or card issuer, the donation is treated as not having been made.
You will receive an emailed receipt carrying a reference number. Please keep it.
RECURRING DONATIONS
If you choose to give monthly, your payment method will be charged the same amount each month until you cancel.
To cancel or change a monthly gift, contact us at divinelovecaresfoundation@gmail.com or +1 (347) 647-7697. We will stop the next scheduled payment provided we receive your request at least [NUMBER — 5 IS TYPICAL] business days before it is due. There is currently no self-service cancellation page on this website; a request to us is the way to stop a recurring gift.
REFUNDS
Donations are gifts and are generally not refundable.
We will, however, refund a donation where it was made in error, in a duplicated amount, or without the authorization of the payment method holder, provided you contact us within [NUMBER — 30 IS TYPICAL] days of the donation and we are able to verify what happened. Contact us with your reference number.
If you believe a payment was made fraudulently using your card, contact us and your card issuer immediately.
HOW DESIGNATED GIFTS ARE USED
Where you direct a gift to a particular program or project, we will apply it to that purpose.
If that purpose is already fully funded, has been completed, or cannot proceed for reasons outside our control, the Foundation's board may apply your gift to another purpose as close as reasonably possible to the one you chose. We will say so publicly on the project page rather than quietly reallocating funds.
Gifts given where the need is greatest are applied at the Foundation's discretion across its work.
The Foundation retains full control and discretion over the use of all contributions, as required for organizations of our type.
TAX DEDUCTIBILITY
DivineLoveCares Foundation Incorporated is a tax-exempt organization under section 501(c)(3) of the Internal Revenue Code, EIN 33-1917805, recognised by the Internal Revenue Service with an effective date of 23 October 2024. Contributions are tax-deductible in the United States to the extent permitted by law. No goods or services were provided in exchange for your contribution unless we state otherwise in your acknowledgment.
We cannot give you tax advice. Please consult your own tax adviser about your particular circumstances.
VOLUNTEERING
Submitting a volunteer application does not create an offer, a contract, or an employment relationship of any kind, and does not guarantee a placement.
Because our work involves a halfway home and a nursing college, certain roles require relevant qualifications, references, or background checks. We may require these before any placement, and we may decline any application at our discretion. Volunteers accepted into a placement will be asked to follow the policies of the Foundation and of the site where they serve, including confidentiality regarding the people served there.
EVENT REGISTRATION
Registering for an event reserves a place; it is not a ticket purchase, and no payment is taken through this website for event registration. Places may be limited. We may change, postpone or cancel an event, and we will tell registered attendees if we do.
NEWSLETTER
You may unsubscribe at any time using the link in any newsletter, or by contacting us. We may still email you about a specific donation, volunteer application or event registration you submitted.
INFORMATION YOU SUBMIT
You are responsible for the accuracy of what you submit through our forms, and you agree not to submit anything false, misleading, unlawful, abusive, or belonging to someone else.
If you send us a story, photograph or other material, you confirm that it is yours to share, and you grant us permission to use it in connection with our charitable work. You can withdraw that permission at any time by contacting us, and we will stop using the material.
Do not send us anyone else's personal or confidential information — particularly about a resident of the halfway home, a patient, or a student — unless you have that person's clear permission.
ACCEPTABLE USE
You agree not to attempt to gain unauthorized access to any part of this site or its administrative area; not to interfere with its operation or security; not to use automated tools to scrape, copy or harvest content or contact details; not to submit automated or fraudulent form entries or payments; and not to use the site to send unsolicited commercial messages.
We may block access where we reasonably believe this section has been breached.
OUR CONTENT
The text, images, design, code and other material on this site belong to the Foundation or are used with permission, and are protected by copyright.
You may read, print and share pages for personal, non-commercial purposes, and you may quote short passages with attribution. You may not republish substantial parts of the site, use our name or logo to imply endorsement, or use our content commercially without our written permission.
Photographs of identifiable people may not be copied or reused in any circumstances, whatever the purpose.

AVAILABILITY OF THE SITE
We aim to keep this website available, but we do not guarantee it will be uninterrupted or error free. We may suspend, withdraw or change any part of it without notice, including for maintenance.
DISCLAIMER AND LIMITATION OF LIABILITY
This website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, the Foundation and its directors, officers, employees and volunteers will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of your use of this website. Nothing in these terms limits any liability that cannot be limited under applicable law, including liability for fraud or for death or personal injury caused by negligence.
INDEMNITY
You agree to indemnify the Foundation against any claim, loss or expense arising from your breach of these terms or your misuse of this website.
GOVERNING LAW
These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute arising from them will be brought in the state or federal courts located in Kings County, New York, and you agree to the jurisdiction of those courts.
CHANGES TO THESE TERMS
We may update these terms from time to time. The date at the top shows when they were last changed, and the version published here is the one that applies. Continuing to use the site after a change means you accept the updated terms.
SEVERABILITY
If any part of these terms is found unenforceable, the rest continues to apply.
